Eviction and Foreclosure Moratoriums End

The CARES Act has provided protection against eviction and foreclosures during the turbulent times of the last year. The moratorium against evictions and foreclosures have begun to end across many states, and the federal level. In hopes of extending the protection provided by the moratorium, the CDC filed to extend the moratorium.
However, a federal judge ruled the CDC on its own does not have the authority to extend the eviction moratorium on May 5, 2021. This means millions of families could very soon face losing their homes to landlords or their mortgage holder.
How Bankruptcy Can Help
The bankruptcy process can protect against foreclosure and eviction. When your mortgage is past due, filing for bankruptcy can halt the foreclosure process. The bankruptcy court can set up a payment plan or decide to forgive the mortgage debt. In addition, if you are in danger of losing your home or apartment, you may be able to stay in your unit by filing for bankruptcy. In many cases, bankruptcy can provide the relief needed to get back on financial track by also resolving outstanding utility payments and credit card debt.
