The far reaching consequences of the pandemic may be slowing in some ways, but ramping up speed in others. Eviction Court Rules

In March of 2020, the federal government issued a nationwide eviction moratorium, which prevented tenants from losing their rental homes amidst the pandemic. In August of this year, that protection ended. As a result, eviction court hearings are packing the scheduling books as a backlog of evictions pends the decision of a judge. Oftentimes, these court decisions take only minutes to process; changing the future of the tenant before their eyes.

Dallas and Fort Worth court rooms are processing eviction cases at a rate of 8 per hour; many of which are only past due balances less than $5000. The court decisions are brief, but do take into account a lot of variables from how long the payments have been delinquent to the history of the landlord’s rental compliance. However, most often the ruling is in favor of the landlord. For tenants facing swift eviction, matters are made worse when the rental assistance programs are overbooked and cannot process applications in time to save some tenants from eviction. Further, landlords are not required to participate in rental assistance programs, leaving some tenants with no choices even if they could find funding.
